One of the most traumatic events in a person’s life may be to find out that a family member has died in a motor vehicle accident. Unfortunately, this is what one family recently had to endure following a fatal car accident in California. The incident occurred early in the morning on a Saturday.

The accident happened when a car suddenly spun out of control on the connector ramp of a highway in San Jose, police said. The car ended up crashing into a retaining wall made out of concrete. Both the driver and a female passenger got out of the vehicle, according to police.

That’s when another vehicle struck their car because its driver couldn’t come to a stop in time. This force of the collision pushed the female passenger, said to be 27, over the retaining wall. She landed on an off-ramp and died at the accident scene, authorities said. It wasn’t clear whether the car that hit the woman directly or ended up pushing the car she had been riding in right into her. Both drivers suffered injuries and were taken to the hospital.

Police said neither alcohol nor drugs appeared to be causal factors in the collision; police continued to investigate the car accident. The family of the deceased woman may choose to file a wrongful death claim in this case, seeking monetary damages that can help to pay for her funeral expenses and other monetary losses tied to the collision. Competent proof of negligence on the part of one or more parties to the accident is necessary in order for the victim’s family to establish liability and have their claims for financial relief adjudicated by a California civil court.
