California pedestrian accident results in fatality and injuries

Sadly, the rate of auto-pedestrian accidents seems to be on the rise all across the country. The simple truth is that many of these accidents could be easily avoided if drivers were paying closer attention to their surroundings. This appears to have been the case for a recent pedestrian accident in California that killed one woman and injured two children.

Earlier this month a woman and two young children were hit by a San Diego utility truck while they were crossing the street. The 39-year-old mother of four was taken to a local hospital for treatment of the injuries she suffered. Despite receiving medical care, she later succumbed to those injuries. The two children with her, her 4-year-old daughter and another 5-year-old girl, were also injured in the crash. They were transported to a children's hospital for treatment of minor injuries.

Authorities have determined that the 55-year-old male truck driver was at fault for the accident due to his inattentiveness. Local authorities do not believe speeding or intoxication were contributing factors to the tragic incident. The case has been sent to the City Attorney to decide if criminal prosecution is warranted.

A pedestrian accident that ends in injury or fatality can have effects that are far-reaching. Families that have lost a loved one in such a tragic way may face emotional and financial challenges for years to come. The family of the mother who was killed and daughter who was injured may be entitled to file both a wrongful death claim and personal injury claim against the driver. The family of the other young girl who was injured may also be able to file a personal injury claim. If liability is affirmed, a California civil court could award financial remuneration to help with medical, funeral, recovery and other expenses that may have resulted from the accident.
