What to do after your child has been injured in an accident

In our last post, we discussed a new study on head injuries in children that was conducted by researchers at the University of California’s Davis School of Medicine and published recently in the New England Journal of Medicine.

The study showed that falls, car accidents and bicycle accidents are predominant causes of head injuries in children. While these serious accidents can sometimes be prevented with safety measures like helmets and seatbelts, that is not always possible when a negligent third party is involved.

When a child suffers a serious head injury, significant medical treatment is often involved -- such as CT scans and possibly surgery -- which can be very expensive. The good news is that the family is often able to be compensated for these costs in personal injury claims against responsible parties.

The first step in pursuing a personal injury claim is meeting with an experienced attorney who can evaluate the facts of your case and help you determine a course of action. Because there are time limits on when these claims must be filed, it’s important to meet with attorney as soon as possible.

The attorney will investigate the accident, the medical treatment that was administered and the limitations the child could have for the rest of his or her life because of the accident. This evidence will then be used to back up the amount of compensation being sought from the responsible party and/or that party’s insurance company.

Pursuing a personal injury claim can also provide the family with a sense of justice and the belief that similar accidents will be avoided in the future.
